NNAMDI KANU: APPEAL COURT POSTPONES RULING ON KANU'S BAIL APPLICATION TO A LATER DATE....UPDATE FROM COURT 5TH MAY 2016
The court hearing on the appeal filed by counsel to Nnamdi Kanu, Barrister Ifeanyi Ejiofor against denial of bail to Nnamdi Kanu and appearance of "masked witnesses", resumed today at the Federal Court of Appeal Abuja. The judge, Honorable Justice Moore Aseimo Adumein appeared on the bench at about 9.31 am after a long wait. This was followed by the introduction of the defense team which includes our able Barrister Chucks Muoma [SAN], and the introduction of the prosecution team led by Barrister Diri Mohammed. The leader of Indigenous People of Biafra, Mazi Nnamdi Kanu did not appear in court at the resumed hearing today.
Chuks Muoma informed the court of the motion filed on the 8th April 2016, which is the application against the denial of bail to the leader of the Indigenous People Of Biafra, Nnamdi Kanu urging the judge to grant the application.The prosecuting counsel to the federal government of Nigeria raised an objection to SAN Muoma's plea, asking the court to dismiss the appeal of Nnamdi Kanu because in his words it "it lacked merit"

Justice Moore, relying also on the argument raised at the Federal high court by John Tsoho, where he [John Tsoho] compared the case of Asari Dokubo with this case of Nnamdi Kanu, then insinuated that since Dokubo was not granted bail during his case with the Federal government, Nnamdi Kanu should be denied bail as well. In other words, the judge was comparing the case of Nnamdi Kanu with that of Asari Dokubo, the Ex-Niger Delta Militant, but Barrister Chuks Muoma [SAN], the defense counsel told the court that Nnamdi Kanu's case is quite different from that of Asari Dokubo. He went further to buttress his argument that Asari Dokubo and his members were violent, but IPOB has never exhibited any act of violence as a people considering all the peaceful protest that has been carried out, and Justice Moore agreed with his argument.
SAN Chuks Muoma also argued that the issue of bail denial for the other two appellants, Benjamin Madubugwu and David Nwawusi was not deliberated upon at the lower court as they were about filing for a bail application on their behalf before John Tsoho denied them bail alongside Nnamdi Kanu. Justice Moore took note of this fact before deliberating with the lead judge on what move to make next. It will be noteworthy that three appeals were filed by the defense counsel to Nnamdi Kanu at the federal court of appeal. The first is the issue of bail denial which has been heard today.

It will be recalled that this case first came up for hearing at the Court of Appeal on the 25th of April 2016. It was unfortunate that on the said date, the case
was not heard on the basis of the week being set aside for a conference for all Judges. Consequently, the case was adjourned to the 5th May 2016, being today. Barrister Ifeanyi Ejiofor who spoke to our correspondence after the court proceedings of 25th April explained that it is a yearly conference which indeed was to hold that very week, urging all to be patient as he is very hopeful that Nnamdi Kanu will get justice at the appeal court.
However,the court unceremoniously ended with the lead judge, Ahmed Aboki saying that the Appeal Court would reserve ruling on the application for now and that a date for the reserved ruling would be communicated to the parties involved in the case.
So as at the time of filing this report, no date has been fixed for the next hearing. However, the defense counsel Barrister Ifeanyi Ejiofor granted an interview to Biafra Writers Correspondent after the court session. We will be bringing to you the details of that interview as soon as possible.
